CUSTOM AUTO EXOTICS LLC – COMMERCIAL TERMS & CONDITIONS

Booking an appointment, accepting a commercial quote, submitting a payment, or dropping off a vehicle for any restyling, customization, or protection service constitutes agreement to these terms.

1. BOOKING, DEPOSITS, MILESTONES, AND CANCELLATIONS

• Non-Refundable Booking Deposit: To secure an installation time slot and initiate the purchasing of vehicle-specific materials, a non-refundable 50% deposit is strictly required. If the project is canceled or abandoned by the Customer for any reason, this payment is permanently forfeited.
• Cancellation & Rescheduling Window: Requests to reschedule or cancel an active appointment must be formally submitted in writing at least 48 hours prior to the scheduled drop-off window. Failure to notify the shop within this 48-hour timeframe results in the absolute forfeiture of the deposit.
• Project Scope Modifications: Any additions, styling changes, or material alterations requested by the client after installation has commenced must be approved in writing, will incur separate itemized labor/material charges, and will extend the estimated vehicle delivery timeline.

2. VEHICLE SURFACE PREPARATION, DROP-OFF CONDITION, & ADHESION RISKS

• Surface Cleanliness & Prep Fees: Vehicles delivered to the shop for Paint Protection Film (PPF), Vinyl Wraps, or Ceramic Coatings must arrive thoroughly washed and free of heavy mud, road grease, or structural debris. Vehicles requiring intensive decontamination, mechanical claybar execution, or extra clean prep will accrue an additional preparation fee.
• Pre-Existing Surface Damage: A mandatory pre-service physical walk-through will be documented on our drop-off form. Custom Auto Exotics LLC assumes zero liability for pre-existing scratches, paint chips, dents, cracked glass, structural metal flaws, clear coat failures, or degraded factory weather stripping and rubber seals.
• Surface Defects & Adhesion Failures: Pre-existing paint imperfections, deep body lines, or weathered trim can severely restrict film or vinyl adhesion. Resulting application flaws caused by these compromised pre-service vehicle attributes are classified as industry-acceptable variations, do not constitute a breach of contract, and form zero grounds for discounts or refunds.
• Aftermarket & Non-Factory Paint Disclaimer: We cannot guarantee, track, or warranty film or vinyl adhesion on repainted, touched-up, or aftermarket-sprayed body panels. The Customer assumes all financial risks regarding clear coat delamination or paint peeling on non-factory paint during both the installation process and eventual film removal.

3. SERVICE-SPECIFIC DISCLAIMERS & ACCEPTABLE INDUSTRY VARIATIONS

The Customer explicitly acknowledges and accepts that automotive vinyl and film applications are flexible aftermarket treatments laid over rigid, complex panels. The following physical characteristics are standard, acceptable industry variations and do not qualify as installation errors:

• PPF & Vinyl Wraps: Minor relief cuts, seams, minimal stretching marks, or slight color shifting around tight panel corners, deep recesses, and rubber moldings are necessary to guarantee long-term film stability. Microscopic specks of trapped airborne dust or tiny adhesive lines can occasionally appear and are standard within industry traits.
• Window Tinting Settlement: Small moisture bubbles or a hazy appearance are a natural characteristic of water evaporation curing. Full clarity can take 3 to 4 weeks to disappear completely. Windows must remain completely rolled up for a minimum of 3 to 5 days post-installation.
• Wheel Powder Coating: The shop is not liable for structural wheel flaws, internal metal pitting, or hidden chemical oxidation exposed during high-temperature baking or aggressive sandblasting media treatments.
• Commercial Wrap Restrictions: Custom printed wraps may experience minor panel alignment variances due to factory body gaps. Slight color shifts from electronic visual mock-ups to physical printed vinyl are normal and do not justify free reprints or project adjustments.

4. BINDING COLOR MATCHING & PARTIAL REWRAP RESTRICTIONS

• Batch Variation & Environmental Aging: Due to factory print-batch variations, material aging, UV fading, or absolute product discontinuation by film manufacturers (e.g., 3M, Avery Dennison, KPMF), newly ordered film may not achieve a 100% exact match to an existing wrap.
• No Match Guarantees: This material limitation applies fully to warranty work, paid collision repairs, or partial panel enhancement services. Visible changes in sheen, color saturation, or texture across partial repairs are industry standard and do not qualify for rework, invoice adjustments, or refunds.

5. PAYMENT POLICIES, CASH DISCOUNTS, AND STORAGE FEES

• Payment Cleared Prior to Release: Full payment of the remaining 50% balance is due immediately upon notice of project completion. No vehicle will be unlocked, un-docked, or released from our Montgomery shop until the invoice balance is cleared in full through Square.
• The 3% Cash Discount Structure: All published catalog rates represent our standard card payment price. A 3% cash discount is applied strictly to final balances settled via physical cash, certified cashier's checks, or verified ACH/direct bank transfers. Any switch back to credit or debit cards instantly invalidates this discount.
• Material Out-of-Stock Status: If a customized project is partially delayed due to sudden manufacturer material shortages, the Customer may leave the vehicle securely at the shop or opt for a temporary pickup. Full payment for all labor and materials consumed up to that exact date remains due prior to vehicle release.
• Daily Vehicle Storage Penalties: Vehicles not officially collected within 48 hours of completion notice are subject to a strict storage fee of $50 per day unless prior written parameters have been authorized by management. Vehicles left more than 5 days are subject to an extended storage rate of $75 per day.

6. TEXAS MECHANIC’S LIEN LAWS AND SECURITY RIGHTS

• Possessory & Constitutional Lien: Pursuant to Chapter 70 of the Texas Property Code and Article XVI, Section 37 of the Texas Constitution, the Customer hereby grants Custom Auto Exotics LLC a continuous possessory mechanic’s lien, artisan's lien, and security interest over the vehicle, keys, and accessories to secure the payment of all labor, materials, storage, and processing fees incurred.
• Right to Detain Vehicle: In the event that the customer refuses to pay the full invoice balance or stops payment via a card platform, Custom Auto Exotics LLC reserves the absolute right to legally retain and hold possession of the vehicle at our physical shop facilities.
• Foreclosure by Public Sale: If any invoice remains unpaid for more than thirty (30) days after formal notice of completion, Custom Auto Exotics LLC may initiate foreclosure proceedings on the lien and sell the vehicle at public auction to satisfy the debt in accordance with Texas Property Code § 70.004, holding the customer liable for all deficiency balances and collection overhead.

7. CHARGEBACK & PAYMENT DISPUTE WAIVER POLICY

• Cardholder Authorization Acknowledgment: By processing transaction deposits or final invoices via card swipes, digital chips, or secure electronic checkout links, the client certifies they are the authorized cardholder and explicitly authorizes all charges.
• Irrevocable Waiver of Reversal Rights: Custom restyling is a labor-intensive installation. The Customer permanently waives their right to file a credit card chargeback with their issuing bank for claims regarding "Services Not as Described," "Defective Workmanship," or "Undelivered Merchandise". Any quality concerns must be resolved directly with the shop using our Section 8 rules.
• Dispute Liability & Recovery Overhead: If a customer initiates a chargeback dispute despite this signed waiver, this agreement will be submitted to the bank as definitive proof of authorized service delivery. If a dispute is executed, the client remains fully liable for the balance, transaction processing fees ($25–$50 per instance), internal administrative collection overhead, and reasonable attorney fees.

8. THE 90-DAY LIMITED WORKMANSHIP WARRANTY & "RIGHT TO CURE"

• Workmanship Coverage: We offer a 90-day limited warranty from the pickup date covering installation errors like lifting, peeling, or excessive wrinkling. Manufacturers govern material fading, yellowing, or structural degradation.
• Right to Cure: Customers must allow us the first opportunity to inspect and resolve any workmanship issues via written notice within the 90-day active warranty window. Undergoing unauthorized third-party alterations or DIY fixes instantly voids all shop warranties and will not be reimbursed.

9. MANDATORY VEHICLE AFTERCARE COMPLIANCE RULES

To protect your investment and preserve your 90-day shop warranty, you must strictly follow these care rules:

• The 7-Day Cure Period: Do not wash your vehicle for the first 7 days following your service. Films and coatings require time to fully cure and bond.
• Pressure Washer Warning: Never point a pressure washer nozzle directly at the film or wrap edges. Keep the nozzle spray at least 12 inches away from the vehicle body panels.
• Hand Wash Only: Avoid automatic drive-through car washes with spinning brushes. Use the two-bucket hand wash method with a high-quality pH-neutral soap and dry with plush microfibers.
• Environmental Contaminants: Bird droppings, bug splatter, and tree sap must be wiped off immediately to prevent acids from staining or etching.

10. CUSTOMER-SUPPLIED COMPONENTS & ELECTRONICS DISCLAIMER

• Fitment & Quality Exclusions: We assume zero liability for the fitment alignment, build quality, or electronic functionality of any customer-provided aftermarket grilles, body kits, emblems, spoilers, or replacement lighting housings.
• Sensor Warnings & Diagnostics: Teardown procedures may trigger temporary dashboard fault codes. Clients must return the vehicle to Custom Auto Exotics for initial inspection; visiting an outside dealership first voids shop liability for scan or repair costs.

11. CUSTOMER MEDIA CONSENT

• Promotional Media: Drop-off grants the shop a non-exclusive license to capture and publish promotional media of the vehicle across our official social channels (e.g., TikTok, Instagram, YouTube), with license plates blurred for privacy unless an opt-out is requested in writing prior to launch.

12. PROJECT TIMELINES

• Turnaround Expectations: Standard timelines range from 7 to 14 business days depending on panel complexity. Extensions do not qualify for refunds, and alternative transportation is not provided or reimbursed.

13. LEGAL JURISDICTION AND VENUE

• Governing Law: Governed strictly by the laws of the State of Texas, with all legal proceedings venue-restricted to Montgomery, Texas.
